Massachusetts Divorce Law - Modifications
In a divorce action, all issues relating to the child (or
children) must be resolved at the time of the divorce. These issues
include the amount of child support as well as which parent the
child will reside with.
Between the time that the Divorce Agreement is entered by the
Court and now, there may be a material change in circumstance in
your life or in the life of your former spouse which warrants
modifying the terms of the Order. If you or your former spouse is
able to show the Court that a change in circumstances occurred, then
you may be able to modify some Orders. Generally, child support,
alimony, child custody and visitations can be modified. Some
material changes in circumstances include one of the parents losing
his or her job, or substantially increasing his or her earnings,
remarriage, or criminal matters that may interfere with one of the
parent's life, or with the child.
In other cases, once the Divorce Agreement is finalized and has
been entered by the Court, one parent may wish to move away, either
the next town over, or in a different state or maybe a different
country. That parent will have to go back to Court to modify, or
change, the child custody or child visitation orders.
